Terms of Use

These Terms of Use govern your access to and use of the SnapDash application and the services made available through it. By creating an account or using SnapDash, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree to these Terms, you may not access or use SnapDash.

The SnapDash Marketplace

SnapDash operates a technology platform that connects people who need photographs taken at a specific location ("Requesters") with other users who are willing to travel to that location and take them ("Snappers"). SnapDash provides the marketplace, payment facilitation, and communication tools; it does not itself provide photography services and is not a party to the agreement formed between a Requester and a Snapper when a job is accepted. Snappers are independent contractors, not employees, agents, or representatives of SnapDash, and SnapDash does not direct or control the manner in which they perform their work.

Your Account

You are responsible for maintaining the accuracy of the information associated with your account and for all activity that occurs under it. You agree to keep your login credentials secure and to notify us promptly of any unauthorized use. During registration you are required to verify a mobile phone number, which serves as a security measure and may also be used to sign in to your account. You may hold a single account and may use it in either a Requester or Snapper capacity, according to the role selected in your Settings.

Payments and Fees

When a Requester posts a job, the stated price is authorized as a hold on the Requester's payment method. The hold is captured only when the Requester approves the delivered photographs, at which point the Snapper is paid the job price less SnapDash's platform service fee. If a job expires without being accepted, or is cancelled before delivery, the hold is released and no charge is made. All payments are processed by Stripe, and Snapper payouts are made to a connected Stripe account; by transacting on SnapDash you also agree to Stripe's applicable terms of service. Arranging, soliciting, or completing payment for a SnapDash job outside the platform is a material breach of these Terms.

On-Site Verification

The integrity of the marketplace depends on photographs being taken where and when they are requested. Snappers must be physically present at the job location, as verified by device location services, in order to submit photographs for a job. Circumventing or attempting to circumvent location verification, submitting photographs not taken at the job site, or otherwise misrepresenting a delivery constitutes fraud and will result in removal from the platform.

Content and Conduct

You retain any rights you hold in photographs you upload, and you grant the Requester who paid for a job the rights necessary to use the delivered photographs for their intended purpose. You agree not to use SnapDash to request or capture unlawful, infringing, or invasive content; to harass, threaten, or deceive other users; to post fraudulent jobs or deliveries; or to interfere with the operation or security of the platform. You are solely responsible for complying with the laws that apply to photography in your location, including restrictions on photographing private property and individuals.

Cancellations and Refunds

Requesters may cancel a job before delivery, in which case any hold on their payment method is released and the assigned Snapper, if any, is notified. Once a job has been approved and payment captured, refunds are assessed on a case-by-case basis by our support team. If you believe a charge was made in error, contact us through the app and we will review the matter promptly.

Suspension and Termination

We may suspend or terminate your access to SnapDash, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or created risk or possible legal exposure for SnapDash or its users. You may stop using SnapDash and close your account at any time.

Disclaimers and Limitation of Liability

SnapDash is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, SnapDash disclaims liability for the conduct of Requesters and Snappers, for the quality or content of delivered photographs, and for any indirect, incidental, special, or consequential damages arising out of your use of the platform. Our facilitation of the approval and revision workflow is the extent of our involvement in disputes over deliverables. Nothing in these Terms limits any liability that cannot be limited under applicable law.

Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services or in applicable law. When we make material changes, we will notify you through the app or by other reasonable means. Your continued use of SnapDash after revised Terms take effect constitutes your acceptance of them.
